Welcome to Alessio Varano Inc.’s SMS messaging program (the “Program”). These Terms & Conditions (“Terms”) govern your participation. By opting in to receive SMS messages from us, you agree to these Terms.
1. Program Description
The Program is designed to deliver alerts, occasional marketing messages and offers from Alessio Varano Inc. You will receive messages regarding new property listings, open houses, market updates, real estate tips, and promotional offers via SMS. Message frequency varies.
2. Opt-in & Consent
To participate, you must provide your mobile phone number and expressly opt-in to receive messages. You represent that you are the mobile device’s subscriber or otherwise authorized to receive messages at the number provided. Message and data rates may apply.
3. Unsubscribe / Opt-out
You may cancel the SMS service at any time. To unsubscribe, simply reply STOP to any message from us. Upon receipt of your STOP request, we will confirm your unsubscribe status via SMS and you will no longer receive further SMS messages from us. To re-join, you must opt-in again through the sign-up process.
4. Support / HELP
For support, text HELP to any message you receive from us (or contact our customer care at info@avendu.ca). We will respond with further instructions.
5. Message Frequency & Costs
Message frequency is variable and depends on your interaction with Alessio Varano Inc. and our marketing program. Standard message and data rates may apply from your wireless provider.
6. Privacy & Data Use
Your participation in the Program is subject to our Privacy Policy (see above) which explains how we collect, use, protect and store your information. Your mobile opt-in data will not be shared with third parties or affiliates for marketing/promotional purposes. Service-providers who assist us (for SMS delivery, customer service, analytics) may access your data solely to the extent required.
7. Changes to Program or Terms
We may modify, suspend or terminate the Program (or these Terms) at any time for any reason. If we make a material change to these Terms, we will update the effective date and post them on our website. Your continued participation after such change constitutes your acceptance.
8. Liability Limitation
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ALESSIO VARANO INC. IS NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES RESULTING FROM THE PROGRAM OR YOUR PARTICIPATION IN IT. OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING FROM OR RELATING TO THE PROGRAM SHALL NOT EXCEED $1000.
9. Governing Law & Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of Quebec, Canada without regard to its conflict of laws principles. You agree that any dispute arising out of or relating to these Terms will be subject to the exclusive jurisdiction of the courts located in Montreal, Quebec Canada.
